PURCHASE TERMS AND CONDITIONS

GENERAL
The following Purchase Terms and Conditions (“Purchase Terms”) apply to all orders placed by the customer (hereinafter referred to as ”you”) on the e-shop available through the website https://www.yungsingh.com (“Shop”) controlled by Yung Singh (“we”, “us”, “our”).
Please ensure that you have read and understood our Purchase Terms before placing an order on the Shop.
The inclusion of any products on the Shop at a particular time does not imply or warrant that these products will be available at any time. We reserve the right to discontinue any product at any time.
We reserve the right to amend these Purchase Terms from time to time without prior notice to you.
2. YOUR ORDER
Our acceptance of your order will take place with a confirmation email which will be sent to the e-mail address provided by you along with the delivery information for the ordered product.
If we are unable to accept your order, we will inform you and we will issue you with a refund. This might be because the product is out of stock, or because of other circumstances or events which we could not reasonably plan for, because we have identified an error in the price or description of the product or because we are unable to meet a delivery deadline you have specified. If we have already received payment for such order, we will attempt to refund the applicable amount (less any applicable tax or extra costs covered by us in connection with the refund) using the same method used to make the payment. If, for any reason, alternative arrangements are necessary, we will contact you to settle the refund.
We will assign an order number to your order and tell you what it is when we accept your order.
We will endeavour to dispatch your order as quickly as possible, Monday-Friday excluding public holidays. Orders placed after 12pm GMT/BST may not be processed until the next working day.
If your cart contains a pre-order item, your order will be shipped once all items are available for release.
All numbered limited editions are issued on a first come first serviced basis, these are allocated in the chronological order they are received
3. THE PRODUCTS
The images of products on our Shop are for illustrative purposes only. Your product may vary slightly from those images.
The packaging of products may vary from that shown on images on the Shop.
4. SHIPPING AND DELIVERY
All international orders will be dispatched with a commercial invoice detailing the exact value and description of goods. We will not misrepresent the value of the goods nor purpose for export. Customers are responsible for paying any import fees, duties and taxes applicable in the destination country, as well as any administration and brokerage fees charged by the courier. Failure to pay the invoice as delivered by the courier may result in the goods being returned to us, which will require an additional fee to then reship the goods, otherwise any outstanding delivery and customs charges will be deducted from the refund amount should the customer opt out of a second attempt at delivery. We cannot accept liability for goods seized by foreign customs or denied import for any reason.
If you have placed multiple orders with us, by default these will be shipped separately. If you have any specific shipping requirements or would like to request combined shipping on multiple orders, please contact us at merch@yungsingh.com prior to dispatch.
5. REFUNDS AND RETURN
You have the right to cancel and return your order within 14 days of receiving your products, as long as the item is still sealed, unused and in the same condition as it was delivered. Upon requesting a cancellation, you must return the product by post within 14 days. Customers are responsible for the cost and arrangement of the return shipping. Returns from overseas must be sent DDP (Delivery Duty Paid). Once the returned goods are received and confirmed by us, you will receive a refund for the goods value within 14 days, using the payment method selected at the point of purchase, subject to any deduction in connection with applicable taxes or extra costs covered by us in connection with the refund).
If you receive a faulty or damaged item, please contact us at merch@yungsingh.com and include photographic evidence in your email.
If your goods are returned to us for customs issues or missed delivery, then we will contact you upon their return to us. We will offer either a redelivery at an added charge or a refund minus the shipping and return costs. If there is no response from the customer 30 days after the date of return, then your goods will be refunded via the method of payment used, minus the shipping and return fees.
6. PAYMENT
The following type of payment will be accepted by the Shop: Payment processing: Your credit card / PayPal account will be debited once your order has been placed, in order to reserve your item(s).
7. LIABILITY
Nothing in these Terms shall exclude or limit our liability with regard to any matter for which it would be unlawful for us to limit or exclude our liability.
If we breach these Purchase Terms, we shall only be liable for losses which are a reasonably foreseeable consequence of such breach.
We are not responsible for indirect losses which are a side effect of the main loss or damage, for example loss of profits or loss of opportunity; or for failure to deliver the goods or to meet any of our other obligations under these Purchase Terms where such failure is due to an event that is beyond our reasonable control, which includes but is not limited to fire, flood, storm, riot, civil disturbance, war, nuclear accident and terrorist activity.
Our maximum liability to you for any loss or damage arising in connection with your order on the Shop shall be limited to the total price of your order.
8. APPLICABLE LAW
The laws of England and Wales will apply to our Purchase Terms and Conditions and in particular the provisions established in the Consumer Rights Act 2015 will apply. The courts of England and Wales will have exclusive jurisdiction over any claim relating to the purchase of any products on the Shop.
